Brother bought us biscuits from Hardee's to get us woken up (he delivered them, then went off to get another witness and niece's mom). The five of us met at the courthouse, went through security, and were directed to our courtroom...
Where cousin did not show up.
Judge said he had tried to call cousin before to speak to him about the case, but never got a call back. I gave him cousin's mom's cell # and he called her and said she'd try to find him. Apparently the amount of cousin's claim should kick our case from magistrate court up to circuit court. Brother and witness/friend think cousin was trying to insure this (and screw with us by making people take the day off for nothing) by not showing up. I think cousin is just a loser :) BUT! Judge is going to have a hearing, where cousin must explain his claim and if it doesn't add up to the judge's satisfaction, he'll dismiss. Brother is contemplating upping his claim if we have to go to circuit court - and during conversation before the judge came out, offered me the money to file my own claim for mental distress if I wanted :) I declined, even though I was the one that pointed out I had been through more mental distress than any of them, since both sides had been pulling on me :)
Brother then took all five of us out to lunch. Told us to order whatever we wanted - we had tried to go to Outback Steakhouse, but they aren't open for lunch, so we ended up at Ruby Tuesday. Niece rode with them after lunch, as she had a doctor's appointment. And I wandered home to my kitties and a nap. :)
So we'll get to do it all again later. But apparently, they do both cases at once, so we won't have to go back a separate time for cousin's case (which I wondered about - because if we won our case, having to go back to court for his case would be strange).
Oh, and brother was exceedingly pleasant and respectful to the judge
